DMCA Takedown Policy

1. Overview
Bibliopile respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). This policy explains how copyright owners can notify us of alleged infringement and how we handle those notices.
2. Book cover images
Book metadata and cover images shown in Bibliopile are retrieved from Hardcover. Hardcover images are uploaded by users on the internet. We do not claim ownership of those images. If you believe a cover or other image displayed here infringes your copyright, please send a takedown notice using the process below.
3. How to send a takedown notice
Email a written notice to hello@bibliopile.com with the subject line "DMCA Takedown Notice". To be effective under 17 U.S.C. § 512(c)(3), the notice must include:
- A physical or electronic signature of a person authorised to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by a single notice).
- Identification of the material claimed to be infringing, and information reasonably sufficient to locate it.
- Your name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
4. What we do after receiving a notice
If a notice substantially complies with the requirements above, we will promptly remove or disable access to the identified material and take reasonable steps to notify the user who stored it, if applicable. We may also notify Hardcover so they can address the source image. Incomplete notices may delay action; we will contact you if we need missing information.
5. Counter-notification
If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to hello@bibliopile.com. Under 17 U.S.C. § 512(g), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any district in which Bibliopile may be found), and that you will accept service of process from the person who provided the original takedown notice.
After a valid counter-notification, we may restore the material unless the original complainant files a court action seeking to restrain the alleged infringement.
6. Repeat infringement
We may terminate accounts of users who repeatedly infringe copyright, in appropriate circumstances.
7. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages.
